A federal appeals court is allowing the Biden administration to deport illegal immigrants, under Title 42, to prevent the further spread of COVID-19.

As reported by Just the News, the Biden administration appealed the decision from U.S. District Judge Emmet Sullivan, who ruled that the use of Title 42 to deport asylum seekers was unconstitutional and the federal government needed to stop.

The appeals court overturned the previous ruling and set oral arguments for some time in January. This gives the Biden administration at least three months to deport illegal immigrants under Title 42.

Interestingly enough, Biden had previously considered overturning the Trump-era Title 42 policy, but decided to keep it in place amidst the southern border migrant crisis.

Homeland Security Secretary Alejandro Mayorkas said about 20 percent of migrants crossing the border are COVID positive.
