The 27-year-old man was at the water park with friends and had just dried himself off and dressed in the changing area when he spotted the victim, the Daily Mail reports. He allegedly had "paid particular attention" to the young teen who was with her mother.
When she went into a private stall to change, she saw his phone come underneath the divider and she kicked it away, spooking Warlow and causing him to flee the changing room and the park entirely.
He was identified via the CCTV camera in the changing area and arrested two days later at his partner's home.
The perpetrator from Whales told police his phone started recording on its own after he accidentally dropped it.
However the judge overseeing the case, Geraint Walters, stated it was "perfectly obvious" what Walters was trying to do in that moment. "I would have to be very naive to accept that proposition, as would a jury, had you tried that one on them."
"Having set eyes upon her, you quite purposefully, and with a fair degree of determination, hung about in the changing area - including viewing her through a mirror at one stage - until she entered a cubicle," the judge said. "You entered the adjoining cubicle, and while there you used your phone to film her. She said the phone was plainly recording and she could see herself on it."
Warlow also told police he couldn't remember the code to the "private area" of his phone. Police nevertheless were able to uncover a video of the predator masturbating in an apparent public bathroom stall on the accessible part of his phone.Warlow's lawyer told the court: "Clearly he is deeply ashamed of what's gone on. Mr Warlow states the impact on the victim must have been horrible."
He was sentenced on December 20, but his 6-month jail term was suspended for two years due to sentencing guidelines. The judge ordered Warlow in the meantime to around 90 days of rehabilitation programs.
Judge Walters said to Warlow: "You set eyes upon her and at that moment decided to see if you had any opportunity to film her in a state, no doubt, of undress.
"Your conduct that day has, for a considerable period of time, blighted you. And it will.
"You will be on the sex offenders register. You've lost your partner, by the looks of it. No doubt in any future relationship you have, you will end up coming under the scrutiny of social services."
