The Biden administration extended a Trump-era health policy that allows for illegal immigrants to be expelled to prevent the spread of COVID-19 in holding facilities. 

Title 42 was implemented during the Trump administration and is executed through the CDC, Just the News reports. 

The CDC said Monday the policy will remain in effect “until the CDC director determines that the danger of further introduction of COVID-19 into the United States from covered non-citizens has ceased to be a serious danger to the public health, and the order is no longer necessary to protect the public health.” 

While the policy allows Customs and Border Protection to send migrants back to their home countries, some children and families are exempt. 

On Monday, amid backlash from immigration activists, the Department of Homeland Security attempted to save face, citing the order as a public health authority, not an immigration authority.
