FOX News will not air a liberal attack ad on Judge Samuel Alito, siding with their lawyers who found the commercial to be factually incorrect. A FOX spokesperson said the network gave backers Alliance for Justice, Leadership Conference and People for the American Way the opportunity to make appropriate changes, but they declined.

The ad charges Alito with ruling to make it easier for corporations to discriminate, voting to approve a strip search of a 10-year-old girl and cites a document where Alito wrote that the Constitution does not protect a right to an abortion.

A spokesman for the groups against Alito, Jim Jordan said, “Roger Ailes [FOX News chairman] doesn’t get to edit our ads.” The spot is still slated air on national cable news programs.
