Team-Left’s Legislation to Pack the Supreme Court: What Is It & What Does It Mean?

In the latest example of progressive hysteria and hypocrisy, a group of democrats formally launched legislative efforts Thursday to pack the Supreme Court by adding four new justices. 

House Judiciary Committee Chairman Jerrold Nadler (D-NY), Chairman of the Judiciary Subcommittee on Courts, Intellectual Property, and Internet Hank Johnson (D-GA), Representative Mondaire Jones (D-NY) and Senator Edward J. Markey (D-Mass) introduced the bill, called the Judiciary Act of 2021, in efforts to create a 13-justice Supreme Court. 

The bill is short, sweet and to the point. It simply revises the section in federal law that says the Supreme Court has a “Chief Justice of the United States and eight associate justices” to say “a Chief Justice of the United States and twelve associate justices.” 

If enacted, Joe Biden will have the opportunity to name four new justices to the Court. Thus, a 6-3 republican majority would turn into a 7-6 democrat majority. 

“We’re here today because the United States Supreme Court is broken,” Markey said. “It is out of balance. It needs to be fixed.” 

Nadler defended the new legislation, urging it’s time for an update to the system. 

“Nine justices may have made sense in the nineteenth century when there were only nine circuits, and many of our most important federal laws - covering everything from civil rights, to antitrust, the internet, financial regulation, health care, immigration, and white collar crime - simply did not exist, and did not require adjudication by the Supreme Court,” Nadler said. 

“But the logic behind having only nine justices is much weaker today, when there are 13 circuits. Thirteen justices for thirteen circuits is a sensible progression, and I am pleased to join my colleagues in introducing the Judiciary Act of 2021,”  he added. 

“Republicans stole the Court’s majority, with Justice Amy Coney Barrett’s confirmation completing their crime spree,” Markey said. “Of all the damage Donald Trump did to our Constitution, this stands as one of his greatest travesties.” 

In 2016, following the death of Justice Antonin Scalia, democrats initiated the #WeNeedNine campaign, calling for an immediate hearing on Obama’s Supreme Court nominee, Merrick Garland. 

Now, in a complete flip-flop of events, they want 13 instead. 

In a statement so blatantly truth and logic it calls to mind the statements of former Soviet politburo members, Nadler said “We’re not packing [the court], we’re unpacking it.” 

While this bill is perhaps at the top of the progressive wishlist, Speaker Nancy Pelosi told reporters on Thursday morning that she has “no plans” to bring the bill to the floor.
