Page 3 — Where Senators Stand on Marriage Amendment

Senate Majority Leader Bill Frist (R.-Tenn.) has announced that the Senate will debate and vote on a Federal Marriage Amendment in the week of July 12.

The language of the amendment has not been finalized. Some conservative senators, moreover, say privately that they are worried that the language currently under consideration is too weak and could open the door for federal judges to force ??¢â???¬?????civil unions??¢â???¬  on the states because it does not forbid legal recognition of such unions.

The proposed language, sponsored by Sen. Wayne Allard (R.-Col.), reads: ??¢â???¬?????Marriage in the United States shall consist only of the union of a man and a woman. Neither this Constitution, nor the constitution of any state, shall be construed to require that marriage or the legal incidents thereof be conferred upon any union other than the union of a man and a woman.??¢â???¬ 

In a statement about this language, Allard said, ??¢â???¬?????Simply put, this means that only a marriage between a man and a woman will be legally recognized as a marriage. This does not prohibit state legislatures from creating other types of legal unions.??¢â???¬ 

Ironically, some Democrats argued in a Senate Judiciary Committee hearing last week that the language would ban states from legalizing civil unions.

Sixty-seven votes are needed to pass a constitutional amendment out of the Senate. From June 22-24, HUMAN EVENTS repeatedly contacted all 100 Senate offices to ask how each senator intended to vote on a Federal Marriage Amendment. The tally: Yes 29, No 18, Undecided 8, Did Not Respond 45.
