The Biden administration has absolutely no respect or consideration for the balance of power as enumerated in the US Constitution. As the Supreme Court weighs its decision in the case of Dobbs v. Jackson Womens' Health Organization, a Mississippi case that could see the overturning of the 1973 Roe v. Wade ruling, the administration’s primary concern is how to counter the court. And if it can't do that, it is demanding that Congress enact its preferred policies, despite not having been able to do so for 50 years.

To that end, the Biden administration is considering executive orders that would, in essence, take power away from the states to make their own decisions on the legality of pregnancy termination and put that power with the White House, where it absolutely does not belong.

Biden, or more likely his aides, are coming up with schemes wherein the Food and Drug Administration would get involved in the distribution of abortion-inducing drugs in states where abortion is illegal past a certain number of weeks or months. They are considering employing abortionists at military bases, where states do not have jurisdiction, and funding women to travel out of state to get abortions if their home state bans the practice.

One of the most egregious plans the administration is considering is the declaration of a public health emergency. If there's anything Biden loves, it's a crisis, because he and his aides can use it to create policy and enforce rules in an emergency setting, casting aside norms or precedents and simply going full force with their own agenda.

While he was running for president, Biden focused on a crisis agenda, proclaiming climate change a public health crisis, along with racism. As the actual problems of governing have faced his administration, some of these emergencies, and his ability to use them to drive federal policy, have faded into the background, but when it comes to abortion, it has become clear that this administration will be ruthless in their fight to retain that right.

And it's not just the Supreme Court and state legislatures that the administration wants to control from the Oval Office, but Congress as well. Speaking to reporters from the press briefing room today, Press Secretary Karine Jean Pierre said that in the event that the Supreme Court decision in Dobbs overturns Roe, the administration would "need Congress to act."

"The administration continues to explore every possible option in response to the anticipated Supreme Court decision in Dobbs, which would take away women's rights guaranteed for nearly 50 years under Roe v. Wade to make their own choices about their reproductive health," Jean Pierre said.

"If the Supreme Court overturns Roe, we will need Congress to take action to restore Roe. I don't have anything else to share on that," she said.

Indeed, Biden issued 77 executive orders in his first year alone, many on pushing an identitarian agenda, with an additional 14 in his second year. Biden approval ratings are on a steady decline. Yet when he and his administration of identity hires are faced with obstructions to their power, they take out their little pens, hold a great big signing ceremony, and go directly against the will of the American people.

If the Supreme Court rules in favor of letting states make their own determinations on abortion, Biden will see that there are many, many Americans who oppose abortion. And no matter how much he presses Congress to enact his will of rule over Americans, he will find that those representatives who would push through these bills do not have the support of their constituents to do it.

Biden likes to say that his administration wants to rebuild the country from the bottom up and the middle out, but this disguises the true approach, which is a top-down mechanism of ruling by executive federal fiat from the White House. Biden is no king, the Oval Office contains no throne, and the American people do not need to be ruled by a dotty old octogenarian who is obsessed with his own plans for the nation, to the exclusion of what the people want.
