A federal judge allowed Biden’s new eviction moratorium to remain in place Friday, saying she didn’t have the authority to block it. 

U.S. District Judge Dabney Friedrich said she was bound by previous rulings from the appeals court above her that said the CDC likely had the authority to impose an eviction ban in the name of public health, per the Wall Street Journal

If there is a judicial order to block the latest eviction moratorium, it must come from a higher court, according to the judge.
