Continuing his exclusive chat with HUMAN EVENTS, Sen. Jeff Sessions (R-Ala.) called Elena Kagan’s political activism and judicial philosophy a “toxic combination,” noting that we have “too much of that on the bench today.” He continued: “[Kagan’s] “philosophy of judging, the judges for whom she’s worked, the judges with whom she seems to admire, they advocate a judge being able to expand the law and to advance it, in an activist way.”

And then there’s question of whether or not Kagan would recuse herself if the legality of ObamaCare’s individual mandate were ever brought before the Supreme Court. “If she were involved, she should not then be on the Court, ruling on matters that she helped develop that are controversial.”
