Sen. Ben Nelson of Nebraska is the first Democrat to announce his official support for Judge Samuel Alito. Nelson, a moderate, said he can’t see any reason why Alito shouldn’t be confirmed.

"I came to this decision after careful consideration of his impeccable judicial credentials, the American Bar Association's strong recommendation and his pledge that he would not bring a political agenda to the court,"said Nelson in a press release Tuesday.

Appearing on Fox's Hannity & Colmes to discuss his decision Tuesday evening, Nelson said although he probably wouldn't agree with all of the judge's past decisions, he respects the way he administers the law.

"I had strong assurances from [Alito] that he does not want to go to the bench and become a legislator. He doesn't want to be a judicial activist. He doesn't want to be somebody that makes law but helps decide law based on cases."

Although Nelson couldn't name another Democrat that would support Alito for certain when asked, he said he doesn't think a filibuster is in the works.

"I think there won't be a filibuster. I've not heard very many people even talking about it. It does get mentioned from time to time. But even, I think as the committee progressed, Senator Feinstein said she saw no reason for..."
