Sen. Chuck Schumer (D-N.Y.) said Monday that Elena Kagan would bring moderation to a polarized Supreme Court.
“Solicitor General Kagan brings both moderation and pragmatism to a court that is sorely in need of both,” Schumer said in his opening statement at Kagan’s confirmation hearing.
But Schumer’s predictions have been off before. Before Supreme Court Justice Sonia Sotomayor was confirmed to the Supreme Court, Schumer called her “mainstream” and “not far left, she’s not far right” during an MSNBC interview.
In the one year of being confirmed, however, Sotomayor agrees most often with the Court’s liberal voting block and has only disagreed with liberal justices Ruth Bader Ginsburg and Stephen Breyer 11 percent of the time.
