Rep. Jeff Sessions (R-Ala.), top Republican on the Senate Judiciary Committee engaged in a colloquy on the Senate floor Wednesday with Sen. John McCain (R-Ariz.) discussing false statements made by Elena Kagan before the Senate Judiciary Committee during confirmation hearings.
Kagan created a hostile environment for the military at Harvard and it took then President of Harvard, Larry Summers, to reverse her decision when faced with the loss of federal funds for systematically blocking military access.
The Judiciary senators say Kagan engaged in deliberate false statements before the Senate Judiciary Committee during her confirmation hearings.
The senators also agreed that Kagan placed her personal views above the law, which calls into question her ability to serve as an objective jurist on the Supreme Court.
A vote on confirmation is expected before week's end.
